Welcome to L'PaBurrito. These Terms & Conditions ("Terms") govern your use of our online food ordering and delivery service available at https://order.elpaburritoph.shop (the "Service"), operated by SpatiaLabs ("we", "us", "our"). By placing an order through the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

L'PaBurrito is an online food ordering and delivery service for custom Mexican and Tex-Mex meals, based in Brgy. San Rafael, San Pablo, Laguna, Philippines. Orders are placed and paid for through our web app, and delivered by our own riders within our serviceable areas.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You are responsible for providing accurate order, contact, and delivery details.

3. Placing an order

When you submit an order, you are making an offer to purchase the selected items. An order is only confirmed once payment is completed and the store accepts the order. We may decline or cancel an order at our discretion, including when the store is closed, an item is unavailable, the delivery address is outside our serviceable area, or we are unable to fulfil the order.

4. Prices and payment

• All prices are shown in Philippine Pesos (PHP) and include applicable charges as displayed at checkout. A delivery fee may be added based on the delivery distance.
• Payments are processed by our third-party payment provider, PayMongo, which is regulated by the Bangko Sentral ng Pilipinas (BSP). We accept QRPh and the other payment methods enabled at checkout.
• Order totals are calculated on our servers at the time of checkout. Payment is collected at the time you place the order.
• We do not store your full card or e-wallet credentials. Those are handled directly by PayMongo.

5. Order acceptance, cancellation, and refunds

• Payment is collected when you place your order. Your order then appears for the store to accept.
• If the store cannot fulfil your order and rejects it, we will refund the full amount you paid through PayMongo. Refunds are returned to your original payment method and may take several business days to reflect, depending on your bank or e-wallet provider.
• Once the store has accepted your order and food preparation has begun, the order generally cannot be cancelled for a refund.
• If you believe there is a problem with your order, contact us using the details below as soon as possible so we can help.

6. Delivery

We deliver within our serviceable areas only. Estimated delivery and preparation times are provided as a guide and are not guaranteed, as they can be affected by demand, weather, traffic, and rider availability. Please ensure someone is available to receive the order at the delivery address and that the address and contact number are correct.

7. Food, allergens, and your responsibility

Our food is prepared in a kitchen that handles common allergens. If you have allergies or dietary restrictions, please review item descriptions and contact us before ordering. You are responsible for checking that the items you order are suitable for you.

8. Store availability

Ordering is only available while the store is open. We may pause or close ordering at any time, including during high demand or outside operating hours.

9. Intellectual property

The L'PaBurrito name, logo, content, images, and the Service itself are owned by SpatiaLabs and may not be copied, reused, or distributed without our written permission.

10. Limitation of liability

To the fullest extent permitted by law, SpatiaLabs is not liable for any indirect or consequential loss arising from your use of the Service. Nothing in these Terms limits any rights you have under Philippine consumer protection law.

11. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available on this page, with the "Last updated" date revised accordingly. Continued use of the Service after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Republic of the Philippines.
